Reducing Tenant Trip-and-Fall Liability on Apartment Common Areas

Residents, guests, delivery drivers, vendors, and employees use the same common routes every day, often while carrying packages, pushing strollers, or walking in low light. When concrete settles, cracks, or drains poorly, those routine trips can become less predictable.

We know property owners and managers cannot prevent every incident, and no repair can eliminate all risk. But in our experience, a consistent program for inspection, documentation, prioritization, and repair can reduce avoidable hazards and support a more responsible maintenance process.

Where Trip Hazards Commonly Develop

Settlement does not always look dramatic. A slab may drop slowly over several seasons, and the difference may be easy to miss until someone approaches it from the wrong direction. Pay close attention to transitions where one surface meets another.

  • Building entrances, vestibules, and service doors
  • Steps, stoops, landings, and handrail locations
  • Curb ramps and designated accessible routes
  • Parking-lot-to-sidewalk transitions
  • Mail kiosks, package rooms, and trash enclosures
  • Pool decks, patios, grilling areas, and courtyards
  • Paths affected by downspouts, irrigation, snow piles, or recurring puddles

Also look for rocking slabs, open gaps, broken edges, ponding water, loose patch material, and abrupt changes at thresholds. These conditions may point to unsupported concrete, continued soil movement, or a repair that is no longer performing.

Build a Repeatable Common-Area Inspection Routine

A good inspection program is simple enough to repeat and specific enough to produce action. Walking the site occasionally without recording what you find makes it harder to recognize changes or prove that a concern was addressed.

  1. Map the routes people actually use. Include primary sidewalks, secondary paths, shortcuts, service routes, amenity areas, and connections to public sidewalks.
  2. Inspect in both directions. An elevation change that is difficult to see from one approach may be obvious from the other.
  3. Check under realistic conditions. Review the site after rain, during low-light periods, and after freeze-thaw season when drainage and elevation problems are easier to see.
  4. Photograph and identify each location. Record the building, route, slab joint, date observed, and nearby landmark so the condition can be found again.
  5. Assign a priority and interim action. High-traffic locations, larger elevation changes, poorly lit areas, and accessibility routes may require faster attention.
  6. Close the loop. Record the repair, confirm the route has reopened safely, and schedule follow-up review when ongoing soil or drainage movement is possible.

Prioritize the Hazard, Not Just the Appearance

A cracked slab is not always the most urgent slab, and an unattractive surface is not always the least safe. Prioritization should consider how the condition affects use.

  • How abrupt is the change in elevation?
  • How many people use the route and how often?
  • Is the condition hard to see because of lighting, shadows, landscaping, or snow?
  • Does water, ice, sand, or leaf debris make the transition less visible or more slippery?
  • Is the area part of an accessible route or evacuation path?
  • Is the slab continuing to move?

Your legal and insurance advisers can help you establish property-specific thresholds and escalation procedures. Maintenance teams should know who can authorize immediate temporary controls and who approves permanent repair.

Use Temporary Controls Carefully

When a condition cannot be repaired immediately, visible warnings, barricades, alternate routing, improved lighting, or other temporary measures may help reduce exposure. Temporary measures should match the location and should not create a new obstruction or accessibility problem.

Paint alone does not repair an elevation difference. A cone left indefinitely is not a maintenance strategy. The goal is to control the area long enough to complete an appropriate repair, document reopening, and remove the temporary measure.

Choose the Right Permanent Repair

The best repair depends on why the surface is uneven and on the condition of the concrete.

Concrete lifting and leveling

When an intact slab has settled because support was lost beneath it, we use polyurethane foam injection to restore support and improve elevation. For polyurethane repairs, small injection holes and fast curing can reduce closure time in busy common areas.

Grinding

Grinding can reduce some small, localized lips, but it removes concrete and may affect surface appearance, drainage, or durability. It does not restore support below a slab or correct a larger drop.

Patching or transition materials

A patch may provide a short-term transition in selected situations, but thin edge patches can crack or detach when the underlying slabs continue to move. The repair should be monitored and should not hide the need for stabilization.

Concrete replacement

Replacement may be necessary when a slab is badly broken, spalled, deteriorated, or affected by a condition that prevents safe lifting. It usually involves more demolition, cure time, access planning, and restoration around the work zone.

How Concrete Leveling Can Reduce Disruption

In our work at multifamily properties, downtime matters. A long closure can force residents into traffic lanes, block an entrance, interfere with deliveries, or take an amenity out of service. Our Smart Lift System® uses polyurethane materials and controlled injection equipment to raise settled concrete with less disruption than full slab removal in appropriate applications.

We drill small injection ports through the slab, place polyurethane beneath it, and monitor the lift as the expanding material fills unsupported areas. Once the slab is aligned and the ports are patched, the material cures quickly. Many repaired areas can return to service shortly after completion.

Address Water Before It Creates the Next Problem

Leveling restores elevation and support, but water management still matters. Downspouts that discharge beside a walkway, leaking irrigation, failed joint sealant, poor grading, or snow-storage practices can continue to move soil and wash out a slab’s base.

During every inspection, look beyond the uneven joint. Note where water comes from, where it collects, and where it leaves the paved area. Coordinate concrete work with drainage, gutter, irrigation, plumbing, or landscape corrections when needed.

Document a Defensible Maintenance Process

Documentation should help your team act, not create a stack of disconnected photos. Use a consistent record that links observation to outcome.

  • Exact location and property identifier
  • Date observed and person reporting
  • Photos from more than one direction
  • Description of the walking-surface condition
  • Priority level and reason
  • Temporary control used, if any
  • Work order, vendor scope, and completion date
  • Reopening confirmation and follow-up date

Preserve records according to your company’s policies and advice from counsel or your insurer. If residents can report maintenance concerns through a portal or office process, make sure those reports reach the people responsible for inspection and repair.

Plan for Northern Illinois Seasonal Conditions

Northern Illinois weather can accelerate concrete movement and make existing hazards harder to manage. Water enters gaps, freezes, expands, and contributes to soil changes. Snow removal can hide edges or damage weak patches. Deicing materials and plow operations can add wear.

A practical schedule includes a detailed spring review after freeze-thaw season, checks after major storms, routine warm-season walks, and a pre-winter review of priority routes. Snow and ice procedures should account for known uneven areas until permanent repairs are complete.
